Who is required to have Workers’ Comp?

Workers’ compensation insurance is required of all businesses in 49 states (Texas doesn’t mandate coverage) and the District of Columbia. In most states, you’ll need workers’ comp as soon as you hire your first employee (which could simply be just the owner). In others, it’s mandated after a certain number of employees. Each state is set up differently and has different criteria. Like some states mandate that the workers’ comp be purchased from a state fund while other states allow it to be purchased from brokers and carriers.
